1. Agreement to Terms

Welcome to Queen Pilates! These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “client”), and Queen Pilates (“we,” “us,” or “our”), concerning your access to and use of the https://queenpilatesstudios.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”) and our services.

By accessing the Site, creating an account, or purchasing and attending our classes, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and our services and you must discontinue use immediately.

2. General Studio Policies

Clients must arrive on time for their scheduled session. To ensure a smooth experience for all clients and to minimize disruptions, entry may be denied if you are more than 5 minutes past your scheduled start time. This will be considered a late cancellation, and the session will be forfeited.

Proper workout attire is required for all sessions. For safety and hygiene, grip socks are mandatory when using any studio equipment. Street shoes are not permitted in the workout areas.

We are committed to providing a safe, inclusive, and welcoming environment for everyone. Therefore, we reserve the right to refuse service to any individual who displays unsafe, disrespectful, or disruptive behavior towards our staff, clients, or the studio property. This includes, but is not limited to, verbal or physical harassment, intoxication, or failure to follow instructor cues.

All purchases of services (including classes, private sessions, and packages) are final and non-refundable.

For the safety of all participants, you must inform your instructor of any injuries, pregnancies, or medical conditions prior to the start of each session.

3. Memberships

Memberships will automatically renew on a monthly basis. To cancel your membership, you must provide written notice at least thirty (30) days prior to your next billing date. Verbal cancellations will not be accepted. Please email your cancellation request to admin@queenpilatesstudios.com.

All membership fees are non-refundable and non-transferable. Memberships may not be shared between individuals.

A hold or “freeze” on your membership may be requested for medical or travel-related reasons. A written request and proper documentation (e.g., a doctor’s note, travel itinerary) must be submitted for approval. A fee of $20 will be charged for each frozen month, for a maximum of two (2) consecutive months. During the freeze period, you will not have access to any studio services.

4. Studio Etiquette

To maintain a focused and peaceful environment, please silence all mobile devices upon entering the studio and refrain from taking calls during your session.

For the consideration of all clients, please clean and wipe down your equipment with the provided cleaning supplies after each use. Return all props and equipment to their designated storage areas.

We foster a community of respect. Please be mindful of fellow clients and instructors, and contribute to a positive and supportive atmosphere within the studio space.

Personal belongings should be stored in the designated areas. Queen Pilates is not responsible for lost or stolen items.

5. Health and Safety Disclaimer & Assumption of Risk

Physical exercise, including Pilates, involves inherent risks of physical injury.

– Assumption of Risk: You acknowledge and agree that participation in any Pilates class, workshop, or other activity at Queen Pilates is voluntary and at your own risk. You hereby assume full responsibility for any and all injuries, losses, or damages that you may incur while attending, exercising, or participating in any activity with us.
– Health Representation: You represent that you are in good physical condition and do not suffer from any medical condition which would limit your participation in the classes offered. It is your responsibility to consult with a physician prior to and regarding your participation in any of our classes.
-Client Responsibility: You must inform your instructor of any pre-existing injuries, illnesses, or conditions (including pregnancy) before the start of every class. You agree to listen to your body and cease any exercise if you experience pain or discomfort.
-Waiver and Release of Liability: In consideration of being permitted to participate in our services, you hereby release, waive, and discharge Queen Pilates, its owners, instructors, and staff from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with your participation in our services, including those allegedly attributed to the negligent acts or omissions of the above parties.

6. Studio Bookings, Cancellations, and Payments

a. Class Bookings: All classes must be booked and paid for in advance through our online booking system available on the Site. Bookings are subject to availability and are not confirmed until payment has been successfully processed.

b. Cancellation Policy: We have a strict cancellation policy to ensure all clients have a fair opportunity to book a class.
Cancellations must be made at least 8 hours prior to the scheduled class start time.

– Cancellations made within this timeframe will have the class credit returned to their account for future use.
Late Cancellations: Any cancellation made less than 8 hours before the scheduled class start time will result in the forfeiture of that class credit, unlimited memberships will pay a $15 fee.
No-Shows: If you do not attend a booked class and do not provide any notice, you will forfeit the class credit, unlimited memberships will pay a $20 fee.

c. Class Packs and Memberships:

– All purchased class packs and memberships are non-refundable, non-exchangeable, and non-transferable.
– Class packs have an expiration date. Please check the specific expiration date at the time of purchase. Expiration dates for standard packs are typically 90 days from the date of purchase. Expired class credits will not be extended or refunded.

7. Late Arrival Policy

To ensure the safety and enjoyment of all clients, we recommend arriving 5 minutes before your class is scheduled to begin. If you are more than 5 minutes late, your spot may be given to a waitlisted client, and you may not be permitted to enter the class. This is for your safety, as proper warm-ups are essential, and to prevent disruption to the other participants.

8. Website and Service Use

a. Permitted Use: The Site is intended for personal, non-commercial use to provide information and allow you to book and pay for our services.

b. Prohibited Activities: You agree not to use the Site to:

-Engage in any illegal activity or to violate these Terms.
– Collect usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.
– Circumvent, disable, or otherwise interfere with security-related features of the Site.
– Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

9. Intellectual Property Rights

Unless otherwise indicated, the Site and all its content, including source code, databases, text, photographs, graphics, and logos (collectively, the “Content”) and the trademarks and service marks contained therein (the “Marks”) are owned or controlled by us or licensed to us. The Content and the Marks are protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from our Content without our express written permission.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Queen Pilates or our owners, directors, instructors, or employees be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or other damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Site or our services or your breach of these Terms and Conditions.

12. Governing Law

These Terms and Conditions and your use of the Site and our services are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any legal action of whatever nature shall be brought in the state or federal courts located in Brevard County,Florida.

13. Changes to Terms and Conditions

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of these Terms. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. Your continued use of the Site after the date such revised Terms are posted will be deemed as your acceptance of the changes.
